Hello,
The current order states support is due to the custodial parent until the child is 18 or graduates high school, whichever is later.

Here is the 2 fold problem. First, the child is 18 as of last year and was to graduate in June 2010.

The child has moved out of the custodial parents home (the natural mother) and has come to live with us (the natural father), the non-custodial parent. I pay a lot of child support and was wondering, how to go about stopping the payments to the mother, since my child no longer resides there and lives with me?

Secondly, my child did not do too well in school while with the mother. The child has (since living with us) dropped out of the high school and has enrolled in an online high school program within the same school district the child was attending before. Grades and missed attendance was such that there is no way the child will graduate on time.

Since the support order states, "18 or high school graduation, whichever is later," does that mean the child support obligation will extend past June 2010 since the child will not be graduating on time?

Personally, I do not think I (or the natural mother) should be obligated to pay past June 2010, however, the court does not always see things the way I see things.

Any info regarding these 2 issues would be greatly appreciated.
